Terms and Conditions

The general conditions for online purchases through the website https://www.fruitsandjewels.com/, owned and managed by «MEDEMA di Pietro Melone».

1. General Provisions

1.1 These general contractual conditions govern the relationship between the Customer and «MEDEMA di Pietro Melone», with registered office in Vallo della Lucania, Via Angelo Rubino, 153 - VAT No. 05710200659.
The contract language is Italian.

1.2 Online purchases pursuant to these General Conditions are permitted only for Customers residing within the European Union. For the purposes of these General Conditions, "Customer" shall mean exclusively the consumer, i.e., a natural person who purchases the Products for purposes unrelated to any entrepreneurial or professional activity.

1.3 «MEDEMA di Pietro Melone» is not required to verify the above conditions; the Customer (or whoever acts as such) assumes full responsibility in case of breach of the provisions of point 1.2.

2. Products

2.1 The products available for purchase are those published on the website www.fruitsandjewels.com from time to time.
«MEDEMA di Pietro Melone» reserves the right to change the type, references, and conditions of the offer at any time depending on availability. The Customer will be informed if the order cannot be fulfilled due to product unavailability.

3. Prices

3.1 Product prices are shown on the website in € (Euro) and include all applicable taxes.
Any shipping costs are not included.

3.2 «MEDEMA di Pietro Melone» constantly checks the correctness of all prices but cannot guarantee absolute absence of errors. Should a pricing error occur, «MEDEMA di Pietro Melone» will allow the Customer to confirm the purchase of the Products at the correct price or to cancel the order.

4. Purchase Methods

4.1 The essential characteristics of the Products and their prices are indicated on the product pages of the website.

4.2 To purchase Products, the Customer must follow the instructions provided on the website. Before confirming the order, the Customer must read and accept the General Conditions (including the terms of the right of withdrawal) and the attached Privacy Policy.

4.3 If the Customer needs to correct errors in entering their data, they must follow the correction procedure provided on the website before submitting the order.

5. Contract Conclusion

5.1 The contract between the Customer and «MEDEMA di Pietro Melone» is considered concluded when the order sent by the Customer has been correctly processed, i.e., when the product is delivered to the Customer’s address, provided that «MEDEMA di Pietro Melone» has received authorization to charge the credit card or confirmation of product availability.
The order sent by the Customer is therefore binding on «MEDEMA di Pietro Melone» only once these conditions have been met.

«MEDEMA di Pietro Melone» is not responsible for any transmission errors attributable to the service provider.

5.2 By placing an order on the website, the Customer confirms that they have read, understood, and accepted the General Sales Conditions, shipping costs, Privacy Policy, and the terms of the right of withdrawal.

5.3 The order will be stored in the website’s database for the time necessary to process it.

5.4 «MEDEMA di Pietro Melone» will send the Customer an order confirmation by e-mail, containing a summary of the order and the specific conditions applicable, including the essential characteristics of the purchased Products, the order date and time, the address of «MEDEMA di Pietro Melone», the detailed price, the payment method chosen by the Customer, and the shipping costs.
The Customer must promptly verify the contents of this message and immediately report any errors to «MEDEMA di Pietro Melone» at: info@fruitsandjewels.com

6. Payment Methods

6.1 The Customer may pay the price of the Products and the shipping costs via PayPal or by credit card belonging to the Mastercard and Visa circuits.

7. Transport and Delivery

7.1 For security reasons, Products purchased on the website will be delivered to the address indicated by the Customer. Deliveries to P.O. boxes will not be accepted.

7.2 For each order placed on the website, «MEDEMA di Pietro Melone» will issue an invoice/receipt of the goods shipped, sending it to the person indicated in the order, in accordance with the applicable laws. The information provided by the Customer at the time of the order is binding. No change to the invoice will be possible after the order is submitted.

7.3 Shipping costs are borne by the Customer and amount to €7.99 for all shipments within the European Union for orders under €40. For orders above €40, shipping costs are covered by «MEDEMA di Pietro Melone».
Delivery times are 2 to 4 working days throughout the European Union.

7.4 Purchased Products will be delivered by courier starting from the working day following the payment confirmation. Orders are processed and delivered Monday to Friday, excluding holidays. «MEDEMA di Pietro Melone» is not responsible for unforeseen delays. Delivery will take place within 2 to 4 working days after the order is placed. Except in cases of force majeure, delivery will be made within 30 (thirty) days.

7.5 Upon delivery, the Customer must check:

* that the number of packages matches the one indicated on the delivery note;

* that the packaging is intact, not damaged, wet, or altered, including in the sealing materials.

Any damage or discrepancies must be immediately reported to the courier by placing a written reservation on the delivery note. Once the document is signed, the Customer can no longer make any claims about the external condition of the package.

7.6 If «MEDEMA di Pietro Melone» cannot deliver the Products ordered due to temporary unavailability, the Customer will be informed by e-mail within 30 (thirty) days. Any amounts already paid will be refunded within the same period.

8. Shipping Notifications

8.1 «MEDEMA di Pietro Melone» will send the Customer a shipping confirmation once the order has been processed.

8.2 «MEDEMA di Pietro Melone» will provide the Customer with a tracking number so that the package can be tracked until delivery.

9. Returns, Order Cancellations, and Right of Withdrawal

9.1 «MEDEMA di Pietro Melone» aims to guarantee full Customer satisfaction and therefore undertakes to refund the full price of returned Products, provided that they have not been worn or damaged, are accompanied by the relevant invoice/receipt, and are returned within the period indicated below. Refunds will be made using the same payment method used for the purchase.
Products may be returned within 14 (fourteen) days from the delivery date. The right of withdrawal does not apply to customized or personalized products and in all cases provided for in Article 59 of Italian Legislative Decree No. 206/2005.
Products purchased online cannot be returned or refunded in retail stores that sell «MEDEMA di Pietro Melone» products. Shipping costs incurred at the time of purchase are non-refundable.

9.2 In case of withdrawal and subject to the conditions set out in points 9.1 and 9.6, the Customer is responsible for the cost of returning the Products to «MEDEMA di Pietro Melone». Any additional costs incurred by the Customer for the return will not be reimbursed.

9.3 In the event of cancellation/withdrawal of an order, «MEDEMA di Pietro Melone» undertakes to reimburse the Customer within 30 (thirty) days from the date of receipt of the request referred to in point 9.1.

9.4 «MEDEMA di Pietro Melone» is not responsible for Products that are lost, stolen, or damaged and therefore does not provide refunds or compensation.

9.5 Pursuant to Articles 64 and 59 of Italian Legislative Decree No. 206/2005, the Customer has the right to withdraw from the contract, without penalty, within 14 (fourteen) working days from the receipt of the Products, except in the case of customized or personalized goods.

9.6 To exercise the right of withdrawal, the Customer must send a formal request to info@fruitsandjewels.com, stating their intention to exercise the right of withdrawal pursuant to Article 64 of the Italian Consumer Code of September 6, 2005, No. 206 (“Codice del Consumo”), specifying the Products concerned, the order number, and their bank details for the refund.

9.7 If the Customer wishes to modify or cancel an order already placed, they must immediately send an email to rimborsi@medemagioielli.it. «MEDEMA di Pietro Melone» will do its best to meet the request. However, once the Product has been shipped, the order can no longer be canceled or modified.

10. Packaging

10.1 Products purchased on the website will be shipped in a padded, sealed envelope containing the product, the warranty certificate, a pouch, and a bag.

11. Errors and Inaccuracies

11.1 «MEDEMA di Pietro Melone» strives to provide constantly updated information on the website. However, it is not possible to guarantee the complete absence of errors. The website may contain typographical errors, inaccuracies, or omissions, some of which may refer to the price, characteristics, or availability of the Product.
«MEDEMA di Pietro Melone» reserves the right to correct any errors, inaccuracies, or omissions, even after an order has been submitted, and to change or update information at any time without prior notice.

12. Authenticity Guarantee

12.1 «MEDEMA di Pietro Melone» guarantees the authenticity of all Products purchased on the website.

12.2 «MEDEMA di Pietro Melone» sells online the original Products of its brand «FRUITS AND JEWELS».
No page or content of this website may be reproduced without prior written authorization from «MEDEMA di Pietro Melone».

13. Non-Conformity Defects

13.1 If the Customer finds any defect of conformity in the purchased Product, they must contact «MEDEMA di Pietro Melone» at info@fruitsandjewels.com within 1 (one) month from the purchase date, specifying "defect of conformity" in the subject line.

«MEDEMA di Pietro Melone» will arrange for the free collection of the item and its replacement and/or repair, covering the shipping costs (outward/return), after verifying the actual presence of a manufacturing defect and excluding that the Product has been worn, used, or damaged.

If «MEDEMA di Pietro Melone» does not find a defect of conformity, the Customer will be contacted with a cost estimate for repair and/or replacement, which will only proceed with the Customer’s consent. In this case, the shipping costs will be charged to the Customer. Repair and/or replacement will be carried out only after payment of repair and shipping costs.

If the Customer requests the return of the Product without repair and/or replacement, shipping costs will be charged to the Customer.
In the absence of communication from the Customer, «MEDEMA di Pietro Melone» is not responsible for Products held in storage for more than 3 months.

14. Reference, Interpretation, Prevalence, Governing Law and Jurisdiction

14.1 For anything not expressly provided for in these General Conditions, reference shall be made to the Consumer Code, as amended, integrated, or replaced from time to time, and subordinately to the Civil Code.

14.2 Any specific time period mentioned in these General Conditions shall be replaced by the longer and more favorable period for the Customer that may be provided for in the future by the Consumer Code.

14.3 In case of conflict, the provisions of the Consumer Code shall prevail over those of the Civil Code, and subject to point 14.2 above, the provisions of these General Conditions shall prevail over those of the Consumer Code, insofar as derogable.

14.4 Italian law applies.

14.5 The competent court is Salerno (Italy).
